According to recent news, Arnab Goswami is out of jail with bail. T And this bail is for a 2018 abetment to suicide case. Police last week only went to Arnab’s home and arrested him. And after a week he is again free for a period of time. This bail is a relief for him in the festive season.
Two judged gave the bail. These two were Justices DY Chandrachud and Indira Banerjee. They passed the statement in the favour of Arnab and against the Maharashtra government. Video Conferencing is the new way to hear petitions by the Court.
“If we as a constitutional court do not lay down law and protect liberty, then who will,” the Supreme Court said during the hearing.
“The victim is entitled to recourse as in proper and fair probe,” the judges ruled.
Earlier, Arnab Goswami was trying to get bail on a permanent basis. He was trying to fight for a plea. This plea was against his arrest as well as the reopening of the case. But the High Court was not in favor of him. The court asked him to approach lower courts for the bail. And the decision by that court will come in four days, the court said.
But now the Supreme Court gave the bail to all the three people. And also bonds worth Rs 50,000 will be furnished.
Supreme Court was also strict for the Maharashtra government. The Supreme Court questioned whether not paying up money amounted to abetting suicide and asked: “If tomorrow, a person commits suicide in Maharashtra and blames the government, then will the Chief Minister be arrested?”
Justice Chandrachud said governments should “ignore taunts on TV” as our democracy is “extraordinarily resilient”, referring to Mr. Goswami’s criticism of the Maharashtra government.
Official Statement Regarding Bail of Arnab Goswami
“But the answer is simple. If you don’t like a channel then don’t watch it… if left to me, I do not watch the channel and you may differ in ideology, but if constitutional courts do not interfere today, we are traveling the path of destruction undeniably,” said the judge.
“If state governments target individuals, they must realize there is an apex court to protect the liberty of citizens… We must send a message today to the high courts as well. Please exercise your jurisdiction to uphold personal liberty,” the court said.
According to the court, the High and Lower Courts does not provide bails. “The cases then flood to the Supreme Court which is already burdened with the workload,” it said.
Mr. Goswami’s lawyer Harish Salve had argued in the hearing: “Is Arnab Goswami a terrorist? Are there any murder charges on him? Why can’t he be given bail?”
